FDUTPA in Real Estate Fraud
The Florida Deceptive and Unfair Trade Practices Act (FDUTPA) applies to real estate transactions as well as construction matters. In Florida real estate fraud cases, FDUTPA claims frequently arise when a seller, developer, broker, or other party in a transaction engages in deceptive or unfair conduct that affects the buyer's decision to purchase or the terms of the transaction.

Title Fraud and Seller Impersonation in Florida
Title fraud - also known as deed theft or seller impersonation fraud - is one of the fastest-growing forms of real estate fraud in Florida and across the United States. According to NAR's 2025 Deed and Title Fraud Survey, 62 percent of recently reported title fraud cases involved vacant land, while only 12 percent involved owner-occupied homes. Florida is among the most targeted states in the country for these schemes.
How Seller Impersonation Fraud Works
Seller impersonation fraud typically follows a recognizable pattern that has been personally observed in the Florida real estate market. Fraudsters identify vacant land, investment properties, or mortgage-free properties - particularly those owned by out-of-state or international owners who are unlikely to be monitoring their Florida property closely. They then:
- Obtain the property owner's personal information from public records, tax databases, and online property listings
- Create forged identification documents and fraudulent notarization to impersonate the property owner
- List the property - often at below-market prices to attract quick cash buyers - using the fraudulent identity
- Push for a rapid closing with minimal verification, often insisting on using their own notary or bypassing standard identity verification procedures
- Collect the sale proceeds and disappear before the fraud is discovered
The fraud is typically not discovered until recording or title transfer - at which point the actual property owner, who was unaware the sale was occurring, learns that their property has been fraudulently conveyed. The buyer, who believed they were purchasing legitimately, is left with a title dispute and potentially significant financial loss.
Florida's Vacant Land Fraud Problem
Florida is a particularly active target for vacant land fraud schemes for several reasons. Florida accounted for approximately 12.8 percent of total land sales in the United States in a recent year, second only to Texas. A significant portion of Florida's real estate is held by non-resident owners - including seasonal residents, investors, and international buyers - who are not physically present to monitor their properties. Vacant land and non-owner-occupied properties are the most vulnerable precisely because their absence of occupancy makes impersonation schemes much harder to detect before a fraudulent transaction closes.

Florida's Recording Notification Service
Recognizing the prevalence of title fraud in Florida, the state enacted Florida Statute Section 28.47 in 2023, requiring each Clerk of Circuit Court to create and maintain a free recording notification service that alerts registered property owners when documents affecting their property are recorded. Property owners - particularly those with Florida vacation properties, investment land, or non-occupied properties - are strongly encouraged to register for this free service with their county clerk. This service provides early warning of potentially fraudulent recording activity that can allow property owners and their counsel to act before a fraudulent conveyance is completed. Condition fraud
Property Condition Fraud and Knowing Concealment
Property condition fraud involves the intentional concealment or misrepresentation of known defects or conditions that materially affect a property's value, safety, or intended use. Unlike inadvertent disclosure failures - where a seller was unaware of a condition - property condition fraud involves a knowing decision to hide, obscure, or misrepresent conditions that the seller or their agents were aware of.
Common forms of property condition fraud in Florida real estate transactions include:
- Cosmetic repairs and finish work performed specifically to conceal known defects rather than correct them - painting over water damage, covering structural issues with new finishes, or applying sealants that mask active water intrusion without addressing its source
- Misrepresentation of the nature, scope, or adequacy of prior repairs on the seller's disclosure form or in the transaction record
- Affirmative misrepresentation of structural systems, materials, or construction characteristics that affect the property's value or compliance
- Failure to disclose known unpermitted work, open permits, or code violations that affect the property's compliance status and value
